			<content:encoded><![CDATA[<p>I’m getting a whole swathe of Coronavirus (Covid-19) emails, WhatsApp messages and news from online/TV/Radios &#038; social channels.</p>
<p>It is ‘crazy time’, ‘panic food stocking/hoarding’, ‘deserted café/streets’, ‘unprecedented time’, ‘tumultuous time’ and government calling for lockdown or shutdown and/or social distancing. </p>
<p>The WHO declared last Wednesday 11th March 2020 that COVID-19 can be characterized as a <em>pandemic</em>. </p>
<p>Even the <a href="https://ico.org.uk/for-organisations/data-protection-and-coronavirus/" title="ICO Covid-19" target="_blank">ICO</a> and <a href="https://edpb.europa.eu/news/news/2020/statement-edpb-chair-processing-personal-data-context-covid-19-outbreak_en" title="EDPB Covid-19" target="_blank">EDPB</a> have announced news. So now we have 3 categories of DPAs approach to the pandemic. @EUstaran (11:47 AM · Mar 17, 2020) tweeted the DPAs’ positions as follows: <strong>Restrictive</strong>: BE, FR, LU, NL <strong>Neutral:</strong> DE, NO, SK, SI, SE <strong>Permissive:</strong> DK, IE, IT, PL, RU, ES, UK</p>
<p>Whatever we call it – epidemic or pandemic –  the one thing that matters to me is that I can stay healthy and have access to my basic needs (air, food, water, electricity &#038; WiFi) and my family and friends.</p>
<p>Scary time for people who feel that they are vulnerable or categorised as vulnerable due to their health or medical conditions. No doubt, everyone wants everyone to be safe.</p>
<p>My student tenant already packed up and left for home (China) and now my niece is packing up to leave for home (Malaysia) too. Her university has shutdown.</p>
<p>This is my 1st experience of what a virus can do to a person, to a country and also at local community. Good to hear/read that neighbourly folks at nextdoor.co.uk are reaching out and offering help for the less fortunate or those affected by the epidemic.</p>
<p>Let us not forget that there are many people who can’t self-isolate or social avoidance or not go to work as they are in the ‘front-line’ and/or are providing essential or basic services that I and so many others rely on in times of crisis or emergencies.</p>
<p>Although the current situation feels like a dawn of a new era, whatever that may be, humanity will find a way to survive. Hope for a new dawn!</p>

<p><strong>Legal issues concerning Data Privacy and Technology generated by the Draft (2012) EU DP Regulation</strong>  presented by Cher Devey</p>
<p>New legal issues concerning data privacy and technology have arisen from the recently drafted (January 2012) EU General Data Protection Regulation (Draft EU DP Regulation) that should be of immediate interest to lawyers, compliance officers, as well as IT professionals. This revised regulation will eventually replace the current Data Protection Act of 1998.</p>
<p>Early this year a draft report on the Draft EU DP Regulation was released by the MEP Jan Phillipp Albrecht. This Albrecht report (the Report) proposes 350 amendments and has been widely reviewed and commented on, not only in the EU but also with mixed reactions from the US industry and government.</p>
<p>Besides the controversial concepts underpinning the proposals (e.g. the Right to be forgotten), technological measures for protecting personal data and the compliance incentives (in terms of penalties) have also stirred heated debates. The Report also stresses the accountability approach and measures including data protection assessment. In particular it introduces the concept of the ‘producer’. Broadly, the ‘producer’ is the entity that creates automated data processing or filing systems to be used by data controllers or data processors. Potentially the ‘producer’ needs to comply with ‘privacy by design’ and ‘privacy by default’ principles. While the exact scope is still in the making, the introduction of such concept has implications for software and hardware designers and developers. </p>
<p>There are many messy questions not only stemming from the data privacy law but also from the confluence of this and technology. Potential topics for discussion;</p>
<p>What do we understand by ‘privacy by design’ and ‘privacy by default’ principles?</p>
<p>Is data protection assessment a data privacy risk assessment or more?</p>
<p>How do organisations assess or identify data privacy and potential exposure to data related events (theft, misuse, abuse)?</p>
<p>The aims of these topics are to invite participants to share their stories, and also explore what are the challenges ahead.</p>
<p>The format of the evening will be a facilitated forum driven by attendees’ questions and discussions.</p>

Besides her professional IT qualifications, being a Chartered Engineer (CEng) and a Certified Information Technology Professional (CITP, British Computer Society), she has also studied specialist modules in computer and communications law (LLM with Queen Mary College, London).She is also a Fellow of the Chartered Institute of Arbitrators (FCIArb) and an accredited CIArb Mediator. </p>

<p>When I am asleep, I guess I have nothing to do with technology unless I am in a technological related dream. This will probably be the end of my spirited being.</p>
<p>Here is an interesting question (or a dream question?) raised by someone at the Sociotechnology and Knowledge Development (sociotech) Group. I see nothing wrong in raising the question in my blog here. Any objections and concerns, please post here or contact cher at iedisc.com</p>
<p>Gosh! has technology got me to be so so cautious?!</p>
<p>The question coming from the sociotech group:</p>
<p><strong><em>What do we really mean by technology?</em></strong></p>
<p>This question sound similar to several questions raised by law/policy makers during an ediscovery conference I attended in 2009 in Barcelona.</p>
<p>Substitute the word <em><strong>‘technology’</strong></em> with <strong><em>‘processing’ or ‘privacy’ or ‘consent’</em></strong> (as in data protection), we end up with more dreamy questions with little common understanding or agreement, especially when discussing on ‘what are the real issues with cross border ediscovery?’.</p>
<p>The questions were based on this statement (or an opinion?):</p>
<p>There is no legal basis (or justification) for ‘processing’ which includes transferring, viewing, accessing etc, of data in ediscovery across the Atlantic (i.e. the Europe &amp; US divide). What? No viewing, i.e. I can’t even open-view the file/data !</p>
<p>I guess the answers were not in the questions being raised, as the only answer that the policy makers were seeking to get assurance is: ‘how safe is my (personal) data’?</p>
<p>So, <strong><em>‘What do we really mean by technology?</em></strong>’</p>
<p>My dreamy reply: ‘technology’ is a beast and also a non beast, a thing and also a thingy.</p>
